Telford Borough is located in southeastern Pennsylvania, approximately 40 miles northwest of Philadelphia.

The Telford Borough Council meeting held this date was called to order at 7:31 p.m. by Stanley Nyce with the following members in attendance: Robert Baker, Carolyn Crouthamel, John Harrell, Scott Hillegass, J. Allen Landis, and Mayor Jay Stover. Also present were Manager Mark D. Fournier, Solicitor Mark Weand, Police Chief Randall Floyd, Recording Secretary Megan McShane, Tax Collector Emiline Weiss, resident Charles Porcelli and a press reporter. Jeffrey Maxwell was absent.

The invocation was given by John Harrell, followed by the pledge of allegiance.

PUBLIC HEARING:

Council President Stanley Nyce opened a Public Hearing at 7:32 pm to discuss and consider comments concerning Proposed Ordinance # 386, which was advertised as required and is stated as such:

1. Ordinance No. 309 is hereby amended as follows:

A. The definition Equivalent Dwelling Unit (EDU) in Section 2 is deleted in its entirety.

B. All references to DER, Department of Environmental Resources, in Sections 2, 3 and elsewhere, are changed to PADEP, Pennsylvania
Department of Environmental Protection.

2. All other terms and provisions of Ordinance No. 309 shall remain in full force and effect as originally adopted.

The Public Hearing was closed at 7:34 pm and there were no comments from the audience.

MINUTES OF PREVIOUS MEETING:

A Crouthamel/Landis motion carried unanimously (6-0) approving the minutes of the December 6, 2010 Borough Council meeting.

TREASURER'S REPORT: No report.

MAYOR'S REPORT:

The Mayor informed Council that he attended the library Board meeting and the Telford Borough Council meeting in December.

POLICE REPORT: We received a written monthly report for the file.

LIBRARY REPORT: We received a written monthly report for the file.

FIRE REPORT: We received a written monthly report for the file.

PUBLIC WORKS REPORT: We received a written monthly report for the file.

MANAGER'S REPORT: We received a written monthly report for the file.

Manager Mark Fournier informed Council that the Borough will not be able to carry over $80,000 in the general fund, as originally planned, due to some large expenses that came up at the end of the year, and due to some real estate taxes that didn't come in as expected. Mr. Fournier will let Council know at next month's meeting what amount the Borough will be able to carry over in the general fund.

BUILDING OFFICIAL'S REPORT: We received a written monthly report for the file.

SOLICITOR'S REPORT: We received a written monthly report for the file.

Solicitor Mark Weand advised Council that the Borough received a zoning variance application from the resident at 22 Branch Avenue, which includes a request to enclose a car port for additional living space. Solicitor Weand advised Council to let the Zoning Hearing Board make the decision on the application.

ENGINEER'S REPORT: We received a written monthly report for the file.

COMMENTS FROM AUDIENCE: There were no comments from the audience.

Z-1 A Harrell/Crouthamel motion carried unanimously (6-0) designating Union National Bank & Trust Company, Quakertown National Bank, and First Savings of Perkasie as depository for Borough funds and authorizing the Borough Manager to invest as he sees fit in the best interest of the Borough.

Z-2 A Landis/Crouthamel motion carried unanimously (6-0) authorizing the Borough Manager to advertise the bids for goods and services, as needed during 2011.

Z-3 A Crouthamel/Baker motion carried unanimously (6-0) re-appointing Emiline I. Weiss to the Vacancy Board, term to expire 1/1/12; David Snook to the Zoning Hearing Board, term to expire 1/1/14; Abram Diehl to the Telford Borough Authority, term to expire 1/1/16; Dwight Kleist, Jr. to the Telford Industrial Development Authority, term to expire 1/1/16; Stanley Nyce to the Recreation Board and Representative to the Northern Montgomery County Recycling Commission, terms to expire 1/1/15; Wendy Leshinskie to the Civil Service Commission, term to expire 1/1/14; Terry Johns to the Planning Commission, term to expire 1/1/16; Scott Hillegass, Representative to Generations, term to expire 1/1/15; Jay Stover, Representative to Indian Valley Public Library, term to expire 1/1/15; Steven Leshinskie, Representative to Indian Valley Regional Appeals Board, term to expire 1/1/15.

Z-4 A Hillegass/Landis motion carried unanimously (6-0) passing Resolution 11-01 to exempt participating fulltime paid policemen from contributing one percent of their wages to the police pension fund for the year 2011.

Z-5 A Harrell/Crouthamel motion carried unanimously (6-0) to borrow funds as needed from the Telford Borough Authority.

Z-6 A Crouthamel/Hillegass motion carried unanimously (6-0) to reappoint Timoney, Knox, LLP as Borough Solicitor.

Z-7 A Landis/Harrell motion carried unanimously (6-0) to reappoint CKS Engineers, Inc. as Borough Engineer.

FINANCE AND ADMINISTRATIVE COMMITTEE: There was no report at this time.

PLANNING & ZONING COMMITTEE: There was no report at this time.

ENVIRONMENTAL COMMITTEE: There was no report at this time.

PUBLIC WORKS/BUILDINGS & PLANT COMMITTEE: There was no report at this time.

PUBLIC SAFETY COMMITTEE:

E-1 A Nyce/Baker motion carried unanimously (5-0) approving Ordinance # 386, which amends Ordinance # 309 as noted at the Public Hearing.

DEVELOPMENT & CULTURE COMMITTEE: There was no report at this time.

OTHER BUSINESS:

EXECUTIVE SESSION:

Borough Council entered into executive session at 8:14 p.m. to discuss personnel matters and a matter of real estate.

Borough Council closed executive session at 9:11 p.m.

A Hillegass/Crouthamel motion carried unanimously (6-0) authorizing the Borough to move forward with acquiring Lot #6 at the Telford Business Park.

The meeting was adjourned at 9:14 p.m. by a Crouthamel/Landis motion.
