The Telford Borough Council meeting held this date was called to order at 7:30 p.m. by Stanley Nyce with the following members in attendance: Robert Baker, Carolyn Crouthamel, John Harrell, Scott Hillegass, J. Allen Landis, Jeffrey Maxwell and Mayor Jay Stover. Also present were District Justice Kenneth Deatelhauser, Manager Mark D. Fournier, Solicitor Mark Weand, Police Chief Randall Floyd, Recording Secretary Megan McShane, Public Works Director Donald Beck, Tax Collector Emiline Weiss, Officer David Bechtel, Detective Dan Fox, Officer Kyle Heffernan, Officer Jeremy Kim, Officer Jim Minninger, Police Department Secretary Gladys Gradel, Jamie Schlessinger from Concord Public Finance, family members of Kyle Heffernan, and a press reporter.

The invocation was given by Jeffrey Maxwell, followed by the pledge of allegiance.

PUBLIC HEARING:

Council President Stanley Nyce announced that there would be a Public Hearing to discuss and consider comments concerning Proposed Ordinance # 383, which pertains to the 2005 Telford Borough Authority Bond Re-Financing. The Public Hearing was closed at 7:40 pm and there were no comments from the audience.

MINUTES OF PREVIOUS MEETING:

A Crouthamel/Landis motion carried unanimously (7-0) approving the minutes of the October 4, 2010 Borough Council meeting, with one correction – under Finance

& Administrative Committee, A-1, the motion to approve the payment of bills was not made by Scott Hillegass, since he was absent from the October 4th meeting. That motion was made by J. Allen Landis and seconded by Carolyn Crouthamel.

TREASURER'S REPORT: We received the written monthly report for October, 2010 for the file.

We've taken in 87.64% of our revenues and have spent 86.37% of our expenditures.

A Hillegass/Maxwell motion carried unanimously (7-0) approving the Treasurer's Report for October, 2010.

MAYOR'S REPORT:

POLICE REPORT: We received a written monthly report for the file.

LIBRARY REPORT: We received a written monthly report for the file.

Mayor Stover reported that construction on the library addition is going well; a "green" roof has been installed. He added that most of the exterior work is complete, and the contractor is now working on the interior.

There will be a wine tasting fundraiser at the library on November 13, 2010. The cost is $50/person.

FIRE REPORT: There was no report at this time.

PUBLIC WORKS REPORT: We received a written monthly report for the file.

The Public Works crew continues to do sewer lateral work on Indian Valley Lane, and will begin leaf collection on Monday, November 8th.

MANAGER'S REPORT: We received a written monthly report for the file.

Manager Mark Fournier continued to work on budget preparation with the Finance Director and department heads.

Mr. Fournier signed the contracts with Kitson Bros. for the necessary roof repairs at Borough Hall; he has not yet spoken with Scatton's regarding the cost estimate for the repairs needed for the air conditioning unit upstairs, but is estimating that we will need a new compressor/unit. Mr. Jeffrey Maxwell asked Mr. Fournier if the unit is 20 years old, and Mr. Fournier confirmed that it is.

SWEARING IN CEREMONY OF PART-TIME POLICE OFFICER:

Kyle Heffernan was sworn in as a new Telford Borough part-time police officer by District Justice Kenneth Deatelhauser. Chief Floyd introduced Officer Heffernan to Borough Council and informed them that he is doing very well with his field training, and has completed all testing, including the firearms qualification test.

BUILDING OFFICIAL'S REPORT: We received a written monthly report for the file.

SOLICITOR'S REPORT: We received a written monthly report for the file.

Solicitor Mark Weand informed Council that he prepared the Earned Income Tax Collector Resolution, which will be presented to Council later in the meeting.

The proposed curfew ordinance is ready to be presented to Council for review.

ENGINEER'S REPORT: We received a written monthly report for the file.

COMMENTS FROM AUDIENCE: There were no comments from the audience.

FINANCE AND ADMINISTRATIVE COMMITTEE: Mr. Hillegass

A-1 A Hillegass/Baker motion carried unanimously (7-0) approving the payment of bills for the month of October 2010 in the amount of $ 451,897.45.

A-2 Jamie Schlesinger from Concord Public Finance informed Council that TBA is ready to proceed with re-financing the 2005 bonds, which are now callable. The Authority will also be borrowing an additional $2,000,000. The new debt will be wrapped around the existing debt, and the borrowing rates are fixed. The Borough is being asked to guarantee the debt in the event that the Authority couldn't pay it. A Hillegass/Crouthamel motion carried unanimously (7-0) with a roll call vote, approving the guarantee of the Authority bond re-financing.

A-3 A Hillegass/Landis motion carried unanimously (7-0) approving the Resolution establishing Berkheimer as the Earned Income Tax Collector for the year 2011.

A-4 Manager Mark Fournier reviewed the proposed budget on a page-by-page basis. This proposed budget included the costs of a full-time police officer. After a lengthy discussion, Council decided to remove the costs of a full-time police officer, and will adopt the 2011 budget at the December 6th meeting with a .35 millage increase.

PLANNING & ZONING COMMITTEE: There was no report at this time.

ENVIRONMENTAL COMMITTEE: There was no report at this time.

PUBLIC WORKS/BUILDINGS & PLANT COMMITTEE: There was no report at this time.

PUBLIC SAFETY COMMITTEE:

PS-1 Prior to the meeting, Council members received a copy of the proposed Ordinance # 384 in their packet (which pertains to the establishment and enforcement of a curfew in the Borough), and discussed this proposed Ordinance at the meeting. A Harrell/ Crouthamel motion carried unanimously (7-0) to advertise Ordinance # 384 for consideration at the December 6th meeting after a Public Hearing.

DEVELOPMENT & CULTURE COMMITTEE: There was no report at this time.

OTHER BUSINESS:

EXECUTIVE SESSION:

Borough Council entered into executive session at 9:39 p.m. to discuss personnel matters.

Borough Council closed executive session at 9:51 p.m. No action was taken.

The meeting was adjourned at 9:51 p.m. by a Landis/Crouthamel.
